1. Grant and relationship with the subscription

ONMAKE grants the customer a non-exclusive licence, limited to the duration and features of the entitlement, to access and run xTdC through authorised channels and use the components necessary for browser operation on their device. The software is not sold. This is not a perpetual licence, source-code assignment or self-hosting entitlement unless separately agreed in writing. Mandatory statutory software exceptions and rights remain unaffected.

This EULA supplements document 01, which prevails on sale, conformity, withdrawal and liability. Features or licences of other ONMAKE products are not included merely because the account is shared.

2. Permitted users and uses

Customers may use xTdC within their plan, including for lawful professional purposes and for study. An organisation authorises only the number of users allowed by the order; personal accounts cannot be assigned or shared. Technical copies in the browser cache and storage are permitted as needed for the service.

Resale, sublicensing, offering the software as a service to third parties, removing access controls, bypassing plan limits, systematic extraction of proprietary components, use of ONMAKE marks to pose as a reseller or licensor, and use aimed at compromising the service or its security are not permitted.

3. Software analysis and interoperability

Disassembly, decompilation and reverse engineering of proprietary components are prohibited except to the extent allowed by mandatory law, including activities necessary for interoperability or lawful study of software functioning. Contract terms do not remove those exceptions. Security research must comply with document 10 and does not authorise access to others' data or service disruption.

4. Content ownership and technical permission

Customers keep their rights in the projects, outputs and reports they create, subject to third-party rights. Because these stay on the device, ONMAKE receives no licence over calculation content; it receives only, for the account, the data described in document 03. Generated outputs remain the customer's and are not subject to ONMAKE royalties for normal use; ownership of them does not include the software, whose licence is governed by this EULA.

The wording "U.S. Provisional Application No. 64/114,486" and the title that accompanies it in the software indicate the status and title of a provisional patent application: they do not amount to a granted patent, independent certification or a guarantee that any individual result is verified.

5. Third-party and open-source components

xTdC uses proprietary and third-party components. Open-source and font licences apply to their respective components and cannot be restricted by this EULA. Required attribution and licence notices are made available with the relevant service or distribution. Any source-code offer obligations apply to the components and uses covered by the respective licence, are not excluded by this EULA and do not automatically transfer every proprietary component.

Users must respect licences for uploaded or embedded fonts, templates, images and content. ONMAKE grants no rights in external resources merely because the editor can open them. Availability or transferability of all document fonts across formats is not promised.

6. Updates and controls

The service may deliver updated components when a page loads and verify subscription entitlement. These controls do not authorise additional content collection or disproportionate blocking of customer documents. Updates necessary for conformity follow documents 01 and 10. Experimental or future features are not automatically included in the commercial licence.

7. Ending the licence and surviving rights

When entitlement ends, permission to use paid features ends, but ownership of documents and statutory remedies do not. Return, export and erasure remain available under document 12; ONMAKE does not withhold documents to compel renewal. Users need not destroy lawfully created outputs. Confidentiality, intellectual property, erasure duties and provisions intended by their nature to survive remain effective.

8. Warranties and governing rules

This EULA does not waive warranties generally. "AS IS" notices in third-party components or technical files do not override ONMAKE's obligations to customers. Liability, governing law and disputes follow articles 14 and 15 of document 01, preserving all mandatory rights.
