1. Four separate actions
Statutory withdrawal is the consumer's right to end a distance contract during the cooling-off period. Non-renewal prevents the next renewal and normally preserves the paid period. Termination for failure to supply or lack of conformity is a separate remedy available when its conditions are met, including after the withdrawal period. Account deletion removes the ONMAKE identity and may affect other applications: it is not required to withdraw from xMath.
This policy does not restrict more favourable mandatory remedies. It concerns the continuing xMath digital service, not automatically equated with downloading a single item of digital content. Business Customers have non-renewal and other contractual/statutory remedies, but no consumer cooling-off right unless expressly offered.
2. Withdrawal period and notice
Consumers may withdraw without giving a reason within fourteen days after contract conclusion. Sending the statement before expiry is sufficient. If required withdrawal information is missing, the statutory extension applies, up to twelve months beyond the ordinary expiry, subject to the rules where information is subsequently supplied.
Consumers may communicate withdrawal by any unequivocal statement sent to info@onmake.it or ONMAKE S.r.l., Piazza Giuliano della Rovere 8, 00121 Rome (RM), Italy. Certified email onmake@pec.onmake.it is optional. The form in article 7 is not mandatory. Sign-in problems do not prevent withdrawal through other channels.
Withdrawing requires only the name, enough information to identify the contract and an electronic confirmation address; no reasons or phone calls are required. ONMAKE promptly sends a durable-medium acknowledgement containing the statement and its date and time. Receipt does not make withdrawal subject to discretionary approval.
3. Immediate performance and proportionate charges
A consumer expressly requesting performance during the fourteen days retains the right to withdraw from the continuing service. Only where all legal requirements are met may a proportionate amount be payable for service actually supplied until withdrawal. Calculation is based on the agreed total price for the purchased period and the part actually supplied, not penalties, increased tariffs or undisclosed activation fees; if the total price is excessive, the relevant statutory calculation applies.
No proportionate payment is due if the express request or required information about the financial consequences is missing. For a continuing subscription, first access, a conversion or an output download does not fully perform the entire purchased service. Any loss of withdrawal rights following full performance requires all statutory conditions and is not presumed from activation. No mandatory blanket-waiver checkbox is provided.
4. Refunds and effects
ONMAKE refunds amounts due without undue delay and within fourteen days of learning of withdrawal, using the original payment method unless expressly agreed otherwise without consumer fees. Any lawfully due proportionate amount is explained with an intelligible calculation. Refunds for non-supply, lack of conformity, incorrect charges or other statutory grounds follow their own conditions and are not discretionary commercial concessions.
Withdrawal stops paid performance and future charges for the relevant contract. ONMAKE confirms termination without automatically cancelling other services or the entire account. Content retrieval is free under document 12 and statutory rights; the return channel is not a paid continuation. Required corrective tax documents are issued without unjustifiably delaying repayment.
5. Disabling renewal
Customers disable renewal through the account/subscription portal or by emailing info@onmake.it before the next charge. ONMAKE confirms the final access date and that no further renewal will occur. Customers need not delete their account or surrender other products. Ordinary non-renewal does not itself refund the entire period already used; withdrawal, conformity and other refund rights remain available.
If a charge occurs after timely non-renewal, ONMAKE checks it and returns amounts not due. Changing a payment method or blocking a card is not a substitute for cancellation notice, but does not authorise unauthorised charges. Renewal is not automatically described as a fresh cooling-off period unless law requires it or a new contract is concluded.
6. Complaints and commercial refunds
Customers may dispute calculations, charges or outcomes at info@onmake.it. ONMAKE reviews and explains its decision without excluding authorities, courts or relevant ADR bodies. Additional voluntary refunds may be considered individually but must remain distinct from, and cannot replace, mandatory refunds.
